By accessing or using Senkly (the website at senkly.app and the mobile application), you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

You must be at least 13 years old to use Senkly. By using the service, you represent that you meet this age requirement. If you are under the age of legal majority in your jurisdiction, you confirm that your parent or guardian has reviewed and agreed to these terms.

To use certain features, you must create an account with accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@senkly.app if you suspect unauthorized use of your account.

Senkly is a couples app that provides features including real-time location sharing, mood logging, shared lists, and personalization through Sparks. We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

You agree not to: use the service for any unlawful purpose; harass, abuse, or harm another person using the service; impersonate any person or entity; attempt to gain unauthorized access to the service or its systems; interfere with or disrupt the service; use the service to transmit malware or harmful code; use automated means to access the service without our permission.

Sparks are the virtual in-app currency of Senkly and can be purchased. Sparks have no real-world monetary value and cannot be exchanged for cash or transferred outside the app. All purchases are final and non-refundable, except as required by applicable law. We reserve the right to modify the pricing, availability, and functionality of Sparks at any time.

You retain ownership of any content you create or share through Senkly (such as list items, mood entries, and profile information). By using the service, you grant Senkly a limited, non-exclusive license to store, process, and display your content solely to provide the service to you and your partner. We do not use your content for advertising or sell it to third parties.

The Senkly name, logo, design, and all related materials are the property of Senkly and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the service without our written permission.

Your use of Senkly is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data.

Senkly is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure. We do not guarantee the accuracy of location data or any other information displayed in the app.

To the maximum extent permitted by applicable law, Senkly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the service. Our total liability for any claim arising from the service shall not exceed the amount you have paid to Senkly in the 12 months preceding the claim, or €50, whichever is greater.

You may delete your account at any time through the app settings. We may suspend or terminate your access to the service if you violate these terms or if we discontinue the service. Upon termination, your right to use the service ceases, and we will delete your data in accordance with our Privacy Policy.

These terms are governed by the laws of the European Union and the applicable laws of the member state where Senkly is established. Any disputes shall be resolved in the competent courts of that jurisdiction. If you are a consumer in the EEA, you retain the protection of mandatory provisions of the law of your country of residence.

We may update these Terms of Service from time to time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Continued use of Senkly after changes constitutes acceptance of the revised terms.
